Arbitration is a formal, confidential process for reaching final resolution of disputes. The most important fact about arbitration is the dispute is resolved by a neutral third party after reviewing the facts and gathering all information relevant to making a decision. The arbitrator’s role is to conduct fact-finding activities both prior to and during the hearing and to use those facts to reach a fair and impartial decision. The Arbitrator can only order the remedies the parties have agreed to in their original contract.  In binding arbitration the arbitrator’s decision is final and must be adhered to by all parties. Conditionally binding arbitration will have pre-determined stipulations on who must accept or reject the Arbitrators decision before it can go into effect.  Non-binding arbitration is also available as an option.

Fee for Service

Arbitration hearings are billed on an hourly basis with most disputes resolved in one session.  The length and number of sessions is determined by the complexity of the situation and continue as long as the Arbitrator determines is necessary for all parties to present their side of the issues and have the Arbitrator gain the knowledge needed to reach a fair and impartial decision.
